That is the main principle that exists in a child custody case. The court will make a determination that is in the best interest of the child. This determination is based on a number of factors listed within the child custody laws of the state of Tennessee. Some of these factors are:
- Stability of each parent;
- Physical and mental health of each parent;
- Existing bonds between the parents and the child;
- The parents ability or willingness to provide food, shelter, clothing, medical care, education, and other necessary care;
- The effect on the continuity in the child’s life and the length of time the child has resided in a stable environment;
- Preference of the child 12 years of age or older.
